As a condition of submitting a photograph or other image ("Image") to this Web site ("Site"), you warrant, represent, acknowledge and agree as follows:

You are at least 18 years old (19 years old if a resident of Alabama or Nebraska, or 21 years old if a resident of Mississippi) or authorized to sign as minor's parent or guardian.
You hereby grant to us a worldwide, perpetual, royalty-free, sublicensable right to use, reproduce, and display the Image and any person's property (physical, personal, and indicia) contained therein, in any media now or hereafter known, without any payment or other consideration of any kind, or permission or notification, to you or any third party. Without limiting the foregoing, you acknowledge and agree that your Image may be displayed on this Site without any fee or other form of compensation provided to you, and that the Image may be viewed by other people visiting this Site. You agree that the Released Parties (as defined below) will have no liability resulting from, or in connection with, the reproduction of the Image, or the failure of the Image to be posted or displayed. You acknowledge that we have no obligation to use the Image.
You hereby waive any claim of alteration, optical illusion, or faulty mechanical or electronic reproduction of the Image, including without limitation, any claim due to any variation of the color, tone, clarity, cropping, or other appearance of the Image. You further waive any and all rights to review, inspect and/or approve any text or copy that may be used in connection with the Image.
You consent to our use (and the use by our partners, parent, subsidiary and affiliated companies, and their advertising and promotion agencies and other designees) of your name, signature, likeness, photograph, opinions, Image and/or hometown and state for promotional, publicity, public relations and advertising purposes in any manner in any and all media now or hereafter known worldwide in perpetuity, without further payment or consideration, permission or notification.
You agree to release, indemnify and hold harmless the Children's Defense Fund and its respective parent, subsidiary and affiliated companies, and its respective advertising and promotion agencies, and any other agency that provides services for any of them, and each of their respective officers, directors, employees, contractors, representatives and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, damage to or loss of property, arising, in whole or in part, directly or indirectly, from the submission of the Image or Released Parties' use of any of the rights granted herein.
You agree that (a) any and all disputes, claims, and causes of action arising out of, or connected with, this Release (including without limitation, any alleged violation of this Release, any controversy relating to the arbitrability of any dispute, or any claim that this Release (or any part thereof) is invalid, illegal, or otherwise voidable (or void)) shall be resolved in the courts in the District of Columbia. You agree that all issues and questions concerning the construction, validity, interpretation, and enforceability of this Release, your rights and obligations, or our rights and obligations in connection with your submission of an Image, shall be governed by, and construed in accordance with, the laws of the District of Columbia.
